Minister of Manpower Regulation Number 13 of 2026 on Guidelines for the Distribution of Government Assistance within the Ministry of Manpower for Fiscal Year 2027 is an administrative law product that regulates the mechanism for distributing government assistance by the Ministry of Manpower for fiscal year 2027. This regulation was stipulated on 16 September 2026 and promulgated on 21 September 2026 in the State Gazette of the Republic of Indonesia.
The process of forming this regulation began with a request for harmonization of the draft ministerial regulation from the Secretary General of the Ministry of Manpower to the Ministry of Law through letter number 1/926/HK/02/VIII/2026 dated 13 August 2026. The harmonization, consolidation, and finalization meeting was held on 31 August 2026, attended by the Harmonization Working Team from the Ministry of Law, Ministry of Manpower, Ministry of Finance, and Ministry of National Development Planning/Bappenas. Based on the Harmonization Minutes signed by the Head of the Legal Bureau of the Ministry of Manpower and the Director of Legal Harmonization II of the Ministry of Law, it was stated that the substance of the draft regulation did not conflict with higher, equal-level regulations, or court decisions.
Subsequently, through letter from the Director General of Legislation of the Ministry of Law Number PPE.PP.01.05-3105 dated 1 September 2026, it was stated that the draft regulation had completed harmonization, and the Ministry of Manpower was requested to immediately proceed with stipulation and submit it for promulgation within 30 working days from the date of the harmonization completion letter. This provision is in line with Article 81 of Law Number 12 of 2011 concerning the Formation of Laws and Regulations, which requires every regulation, including Ministerial Regulations, to be promulgated in order to have binding legal force and be validly enforced.
The formal request for promulgation was submitted by the Secretary General of the Ministry of Manpower, Dr. Cris Kuntadi, S.E., M.M., through letter number B-1/1089/HK.02/IX/2026 dated 16 September 2026 to the Director General of Legislation of the Ministry of Law. The letter was electronically signed and certified by the Electronic Certification Center (BSrE), National Cyber and Crypto Agency (BSSN), so that a wet signature and stamp were not required in accordance with applicable laws and regulations.
Substantively, this regulation serves as a technical and administrative guideline for work units within the Ministry of Manpower in planning, managing, distributing, monitoring, and accounting for the use of government assistance funds for fiscal year 2027. This guideline is necessary to ensure that the distribution of assistance is carried out transparently, accountably, and appropriately targeted, in accordance with good state financial management principles, including synchronization with the policies of the Ministry of Finance as the fiscal manager and the Ministry of National Development Planning/Bappenas as the national development planner.
