Other Institution Regulation Number 9 of 2026 concerning Social Security for Indonesian Migrant Workers was stipulated on August 24, 2026 and promulgated on August 28, 2026, with the main subject of JAMSOS - PMI in the field of Employment Law. The current status of this regulation is in force.
This regulation is a legal instrument issued by the relevant institution to more specifically regulate the implementation of the social security program for Indonesian Migrant Workers (PMI). The background for the issuance of this regulation cannot be separated from the need to provide more comprehensive protection to PMI working abroad, given the various risks faced during the labor migration process, from the pre-placement stage, placement period in the destination country, to the post-placement period after returning to Indonesia.
In substance, this regulation likely governs the types of social security programs that PMI must participate in, including but not limited to work accident insurance, death insurance, and old-age insurance programs. In addition, this regulation also governs the participation mechanism, amount and procedure for contribution payment, benefit claim submission procedures, and sanctions for parties who do not comply with the stipulated provisions.
This regulation also affirms the roles and responsibilities of various parties in organizing PMI social security, including the central and regional governments, the Social Security Administering Body, PMI placement companies, and PMI themselves. Coordination among these parties is key to ensuring the effectiveness of the implementation of the social security program for PMI.
With the enactment of this regulation, it is expected to provide better legal certainty and protection for PMI and their families, while supporting government efforts to improve the governance of placement and protection of Indonesian Migrant Workers in accordance with the principles of fair and sustainable labor protection.
